The military has long recognized that when the unwelcome stench of undue command influence begins to waft through the halls of justice, you’d better hold your nose, because bad things are about to happen. That is why they have regulations in place to seek out and eradicate the influence of commanders on the military judicial process. The primary role of any government is to ensure the safety, security and well-being of its citizens while intruding as little as possible into their personal affairs. The secondary role of any government is to ensure that while fulfilling it’s primary role, the will of the majority is given the utmost consideration. But when the will of the majority is no longer even of tangential concern to the government, particularly when said government engages in unapologetic social engineering, thought control or redistribution of wealth, it is tyrrany that prevails.

On June 4th, 2008, yet another ace was yanked from the house of cards that laid foundation of the government’s case against eight Marines for their actions relating to a terrorist ambush in Haditha, Iraq in November of 2005. 

Although that deck was completely stacked against them and reshuffled repeatedly, five of eight Marines have had their charges dismissed and First Lieutenant Andrew Grayson has faced court martial and was rightly found not guilty on all counts. (more…)

Dismissed With Prejudice

USMC Lance Corporal Stephen Tatum has finally been exonerated of the bogus charges leveled against him. Perhaps now he can begin to rebuild his life in the peace and prosperity he has fought so hard to secure for so many of us.

While I celebrate the decision to drop all charges against this Marine Rifleman, I also view the circumstances that surround that decision with much trepidation. When combined with the history of prosecutorial misconduct in these cases, it is a clear indication of how desperate the government is to nail the 3 remaining Marines, particularly Staff Sergeant Frank Wuterich. Unabashedly Ashamed and Proud of It

Michelle Obama recently said that for the first time in her adult life, she was proud of her country. While I unequivocally disagree;  while I have found many occasions in my adult life to be proud of my country, I can emphatically say that this is not one of them. As a matter of fact; for the first time in my adult life, I am unabashedly ashamed of my country. Ashamed that our Commander-In-Chief would order Marines from Lt. Col Jeffrey Chessani’s 3rd Battalion to battle terrorists in Iraq only to turn his back and hold his nose while these brave men, who should be held aloft on our shoulders and celebrated, are viciously and selectively prosecuted. King County’s Dogged Pursuit of Justice

The right of Americans to choose their representatives through free elections is guaranteed. It has been secured by pen, it has been secured by sword. It has been earned through torrents of blood spilled on the battlefield by American patriots for centuries. But despite the supposed sanctity of that right, it is coming under increasing attack by the current generation of political leadership - whether it be a local elections department or the trifecta of the three branches of the US government.

Every now and then, patriotic Americans who are fed up with incompetent, lazy or heavy-handed public servants speak out or engage in acts of civil disobedience in order to expose flaws in the laws that govern us or the manner in which they are enforced. When these brave citizen soldiers do indeed expose waste, fraud or ineptitude, they ought to be celebrated, not punished. Which calls to mind the case of one such patriot, Jane Balogh from Federal Way, WA.

Someone Should Sue YOUR Pants Off!

They say justice is blind. I submit to you that it is blind, deaf, dumb, lame, mute and stupid. It is also quite tyrannical when brought to bear as a weapon against an individual or the fruits of their labor. One of the biggest problems in America is the plague of frivolous litigation that is clogging up the nation’s court systems. From a spilled cup of hot coffee while driving, to a severed finger planted in a bowl of fast food chili, the claims of irreversible harm and emotional distress encouraged by multi-million dollar jury verdicts continue to border on the absurd.

Recent estimates indicate that the average American coughs up an additional $3,500.00 per year for everyday goods and services [1] as a result of frivolous litigation brought by individuals with an axe to grind. As an orderly society, we cannot function without certain individuals to teach us, guide us, heal us or protect us. That is why we hold professions such as priests, judges, teachers and police officers more accountable than others. It is also why the citizens of Washington DC must hold DC Administrative Law Judge Roy L. Pearson accountable.

The Honorable Judge Pearson is the plaintiff in a frivolous $65 million dollar lawsuit against Ji Nam Chung, Soo Chung and Ki Chung, owners of Custom Cleaners in suburban Washington DC. The suit was brought by Pearson over a pair of his pants that apparently went missing when he sent them for cleaning. Pearson began his assault by asking the Chungs for $1,000.00 - the full price of the suit. The Chungs contended a week later that the pants had been found. They refused to pay, at which point Pearson brought forth his lawsuit.

The Chung’s attorney, Chris Manning said that they made three settlement offers to Pearson - first $3,000.00, then $4,600.00, and finally $12,000.00, all of which were rejected.

Pearson contends that two signs in the Chung’s business, “Satisfaction Guaranteed” and “Same Day Service” amount to fraud because of his dissatisfaction over his pants. As a consequence of this alleged “fraud”, Pearson calculates that -according to DC consumer protection laws- at $1,500.00 per violation per day, the Chungs had 12 separate violations over 1,200 days times three people for 64.8 million dollars. Additionally, Pearson decided that since he no longer wanted to patronize his neighborhood dry cleaners, it was worth another $15,000.00, which he contends would be the cost to rent a car every weekend for 10 years to take his suits to another dry cleaners. And in a final sign of this jerk’s contempt for our legal system, he appointed himself to represent all DC area customers “affected” by signs promising satisfaction, such as were found in the Chung’s establishment.

Sherman Joyce, President of the American Tort Association stepped forward and offered an olive branch to Pearson by offering to buy him the suit of his choice. It is unknown whether Pearson accepted the offer. Thankfully, people in a position to stop this madness are beginning to speak out. Former NLRB chief administrative law judge Melvin Welles wrote the Washington Post, urging that Pearson be immediately disbarred. Pearson may very well be on his way there. On Wednesday, Judge Pearson’s biography page was active, but as of Saturday May 5th, 2007, his biography has been removed from the Office of Administrative Hearings website.

It appears that in this case, the system may in fact work the way it was intended. But even Pearson’s possible disbarment and dismissal from the bench don’t quite go far enough. Rather than being offered a new suit, Judge Pearson should have his pants sued off for malicious prosecution and then be forced to trade in that black robe for something more suitable such as a bright orange or black-and-white-striped jumpsuit with matching wrist and ankle bracelets.

It has long been held that there are two systems of justice in this country. One for the haves, another for the have-not’s. If your pants have deep pockets; If you can afford a flashy attorney schooled in theatrics and skilled oratory, you stand a much better chance of winning. Likewise, one who earns a living practicing the legal profession has a substantial edge over the average citizen when facing off in court. They ought to face substantial sanctions for the “piling on” of frivolous costs and accusations. If there is ever going to be meaningful tort reform, these types of lawsuits must never see the inside of a courtroom.

After hiring, supporting, and then finally accepting the resignation of Amanda Marcotte -a vitriolic Christophobe- as his campaign blogger, he went on television trying to argue that Jesus would be offended at the greed and indifference of the average American. Now it seems that several key endorsements from his home state of South Carolina are slipping away. And thus begins a case study in hypocrisy.

 Lance Corporal Justin Sharratt is a decorated United States Marine. He fought in the battle for Fallujah, modern urban combat at it’s worst, involving house-to-house and hand-to-hand fighting that killed some of Justin’s fellow Marines. But for Justin, Fallujah was only the beginning.

Justin’s father Darryl wants the world to know that although Justin is home from Iraq, he’s still fighting for his life. Justin is charged with three counts of unpremeditated murder during an ambush followed by a ferocious firefight in Haditha, Iraq in November, 2005. When we spoke last Saturday, Darryl sounded upbeat. He had just gotten off the phone with one of his attorneys, while his wife Theresa was one the line with another. He explained that the attorneys seemed satisfied with the progress of defense discovery.

Ockham’s Razor - Exhibit C

Judicial Tyranny. 

The Supreme Court rulings that came down this week with respect to Guantanamo Bay, Cuba, and the treatment of detainees suspected of being terrorists, is not just a defeat for the Bush administration. It is a virtual gold mine to international terrorist organizations.

A couple of years ago, Ruth Bader Ginsburg stated the Court would begin to look to International opinion in rendering it’s decisions about legal matters of importance in this country. Now they are telling us that military tribunals would have to be authorized by an act of Congress. Until then, they must allow our enemy to nakedly use our very own constitutional protections as a weapon against us.

The Admiral who runs the prison at Guantanamo Bay was roundly criticized by members of the press, but 100% correct when he stated the 3 suicides there were acts of asymmetrical warfare.  One attorney actually tried to argue that suicide is against Islam, so it was an act of desperation, instead of enemy propaganda. What a laugh.

Our enemy respects no one’s life, much less their own. They’re blowing themselves up in Iraq like it’s going out of style. And NO MUSLIMS ANYWHERE ON THE PLANET ARE SPEAKING OUT AGAINST THIS MADNESS. They respect nothing but unmitigated violence. The Supreme Court is telling us that we have violated, and also must abide by the Geneva Conventions relative to the Treatment of Prisoners of War. I am telling you they’re wrong.

Article IV of The Geneva Conventions clearly and unequivocally states that a prisoner of war is a person that;

  • Is commanded by a superior officer and is responsible to that officer (as opposed to being grouped in autonomous, decentralized terrorist cells capable of striking independently.)

  • Has a recognizable insignia (badge, flag, uniform, or other identifier). Turbans don’t qualify as insignia or uniforms.

  • Carries their weapons openly (as opposed to using burquas, suicide bombers, and IEDs).

  • Is an inhabitant of the territory who is a party to the conflict, and has taken up arms against an invader, but who also respect the laws of war, (as opposed to international jihadists).

Therefore, once again, the simplest explanation:

If they cannot be classified under the Geneva Conventions as a prisoner of war; if they fight without being commanded by superiors; f they are not from countries who have signed on to the Geneva Conventions; if they don’t respect the most basic laws of war themselves; then then the Geneva Conventions don’t apply.

The effect of the Supreme Court ruling was to tie our hands and create an imbalance in favor of the enemy. We can’t win this war. Not like this. The gloves should come off… NOW. Or we should disengage until we have a plan to win.

In Order To Solve a Problem, You Sometimes Have To Work Backwards Part III - Imminent Threats

The whole purpose for the creation and continuing existence of War Of Wits is to reemphasize the truth for Americans, and to shed light upon the real dangers facing the United States.

The true motives of international terrorist groups.

The constraints that a two-party political system unnecessarily imposes on the US.

The true dangers of political correctness. The damage being done by instructing you not to be judgmental. By allowing ANYONE to label a group, such as the Minutemen -who represent the wishes of millions and are doing what government paralysis cannot do- as vigilantes, racists, or political grandstanders.

The extent of the media bias and outright manipulation that keeps them in the dark about what is truly going on in their government. Nobody cares about the foreign policy opinions of U2’s Bono, or gasbags like George Clooney, Jane Fonda, Tom Cruise, Barbara Streisand, Natalie Maines, Michael Moore, or any other so-called celebrity. We care about the crime in our neighborhoods, the politicians running the country into the gutter, and the internal and external threats. Hollywood celebrities make a killing pretending to be something they’re not. Why on earth would I listen to them?

The lack of imagination, greed, ineptitude, over-inflated egos and sense of entitlement; The utter indifference of the politicians who are selling us down the river. By passing treasonous immigration legislation that drastically affects the entire US infrastructure, quality and way of life. By not respecting the constitutional framework and the concept of state’s rights. By not embracing constructive criticism, and not listening, or being responsive to the needs and desires of the constituents they represent.

The attorneys who have created a culture, where multi-million, or even billion dollar lawsuits, for the smallest of slights is not the exception, but now sadly the rule.

The pedophiles who are trying to recruit and corrupt the nations children, by pushing sex and acceptance of so-called “alternative lifestyles” on children as young as 5 to 8 years old.

The true motives of the illegal aliens, who violate our border, vandalize private property, stress our hospital system, steal our social security numbers, falsify driver’s license and employment applications, steal jobs and social services, depress wages, and then due to some sick sense of entitlement, along with their cohorts who are legal immigrants, march through the streets proclaiming no one is illegal, the border violates them, that they have the “right” to be here. Some of these so-called protesters even had the juevos to carry my flag upside down and spit on anyone who dared to show up to their protest and disagree.

The real danger of the ACLU, who is hell-bent on removing every trace of Judeo-Christian tradition, every depiction, thought, or utterance of God from, not just the public square, but from the public view, the public’s heart, mind, and lips as well.

We will explore all of these topics in the coming weeks. I hope you come away with a new appreciation for the place of the United States on the world stage, and understand that if the US goes down the toilet, the rest of the world is sure to follow.

On this Memorial Day, I would ask that you keep the nation’s veterans, as well as their families in your heart, especially the ones who have made the ultimate sacrifice. It is only through their bloodshed that we are all able to speak freely and voice our opinions.
